Product Description
On August 29, 2023, the U.S. Environmental Protection Agency (EPA) and Department of the Army (the agencies) announced a final rule amending the 2023 definition of “waters of the United States.” The amendments conform with the U.S. Supreme Court’s May 25, 2023, decision in the case of Sackett v. Environmental Protection Agency. While EPA’s and Army’s 2023 rule defining “waters of the United States” was not directly before the Supreme Court, the decision in Sackett made clear that certain aspects of the 2023 rule are invalid.
The result is a complicated set of rules that govern what is and what is not a Waters of the US.
The Swamp School has closely followed this case and the ever-changing WOTUS rules for the last 15 -years. We have prepared a synopsis of the current WOTUS definition and how to identify WOTUS wetlands that are “indistinguishable” from the jurisdictional navigable waters.
Join us for a detailed analysis of the new post Sackett WOTUS procedures and how to successfully navigate the current WOTUS rule.
